Suisun City Fence & Deck provides residential and light commercial deck construction, fence installation, and related outdoor structure services in Suisun City, CA and surrounding communities. The specific scope of services for any project is defined in a written contract or work order signed by both parties. Nothing on this website constitutes an offer to perform services; services are provided only pursuant to a written agreement.
All estimates provided by Suisun City Fence & Deck are based on information available at the time of the estimate and are valid for 30 days from the date issued unless otherwise stated in writing. An estimate is not a binding contract. A project begins only when a written contract has been signed and any required deposit has been received.
Project pricing is based on the agreed scope of work. If conditions discovered during construction - such as hidden rot, soil conditions, or pre-existing structural issues - require work outside the original scope, we will notify you promptly and provide a written change order before proceeding. We do not perform out-of-scope work without your written approval.
Project start dates are scheduled after a signed contract and deposit are received and, where applicable, after permit approval has been obtained. Start dates may be affected by permit processing times, weather, material lead times, or other factors outside our control. We will keep you informed of any significant scheduling changes.
If you cancel a project after signing a contract, any deposit paid may be non-refundable to cover costs already incurred, including permit fees, materials ordered, and scheduling allocation. Specific cancellation terms will be stated in your written contract. Cancellation due to our failure to perform as agreed is handled separately under the dispute resolution terms below.
Payment schedules are specified in each project contract. Typically, projects require a deposit at contract signing, one or more progress payments during construction, and a final payment upon project completion and your acceptance of the finished work.
Final payment is due within the timeframe stated in your contract, which is typically within 5 business days of project completion. Overdue balances may be subject to interest charges as specified in your contract. We reserve the right to suspend work on a project where a scheduled payment has not been received.
Under California law, we have the right to place a mechanic's lien on your property if amounts owed for labor and materials are not paid. We will make every effort to resolve payment disputes before taking that step.
Where required by applicable law, we will obtain necessary building permits on your behalf before beginning work. Permit fees are either included in the project price or billed separately as stated in your contract. You agree to provide reasonable access to your property and to cooperate with any inspections required by local building authorities. Work will not proceed without required permits in place.
We warrant our workmanship for a period specified in your written contract, typically one year from the date of project completion. This workmanship warranty covers defects in installation and construction that are directly attributable to our work.
Materials and products installed are subject to their manufacturers' warranties, which are separate from our workmanship warranty and vary by product. We will provide you with any available manufacturer warranty documentation at project completion.
Warranty coverage does not extend to damage caused by misuse, improper maintenance, acts of nature, normal wear and tear, or modifications made by anyone other than Suisun City Fence & Deck.
To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to services provided under these terms will not exceed the total amount paid by you to us for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages of any kind, including lost profits, loss of use, or costs of substitute services, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations on liability, in which case those limitations may not apply to you.
If a dispute arises between you and Suisun City Fence & Deck regarding services or these terms, we ask that you contact us first at quotes@suisuncityfenceanddeck.com or (707) 247-9905 so that we have a reasonable opportunity to address the issue directly.
If the dispute cannot be resolved informally, the parties agree to pursue resolution through binding arbitration in California before initiating litigation, except where applicable law prohibits mandatory arbitration. Claims that qualify for small claims court may be filed there without first requiring arbitration.
These Terms and Conditions and any contract for services between you and Suisun City Fence & Deck are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration will be brought exclusively in the state or federal courts located in California.
